PROTECTION OF PERSONAL INFORMATION POLICY (POPI)

Privacy Notice

The following Privacy Policy discloses the Privacy practices for Inzalo Safari Lodge on how we treat personal information we collect through our Channels (websites, associated websites, mobile applications, our lodge and other channels – collectively referred to as “Sites”). This Privacy Policy applies when you use any of our Sites. We use your personal data to provide and improve your guest experience. By using the service, you agree to the collection and use of information in accordance with this Privacy Policy.

At Inzalo Safari Lodge we take the Protection of Personal Information seriously and we recognize that Privacy is important to you.

The purpose of this Privacy Policy is to describe how we collect, use, store and disclose Personal Information that you provide to us, what we learn about you from your visit to our website and our Safari Lodge, as well as to explain the choices and rights that you as a data subject has regarding your Personal Information.

All references to ‘our,’ ‘us’ or ‘we’ within this Privacy Policy are deemed to refer to Inzalo Safari Lodge and its subsidiaries.

Information that is collected

To enable Inzalo Safari Lodge to provide you with a premium experience when visiting its Sites, it requires up-to-date and correct Personal Information of its guests. Personal Information includes the prescribed information falling within the definitions of Personal or Special Personal Information as set out in the Protection of Personal Information Act, 2013 ("Protected Personal Information").

Inzalo Safari Lodge collects, with your consent, personally identifiable information, such as your e-mail address, name, home or work address or telephone number. Inzalo Safari Lodge also collects demographic information, which is not unique, but in certain cases, unique to you, such as your age, gender, preferences, interests and other requirements that may be needed to improve your experience.

Children’s Privacy

Our service does not address anyone under the age of thirteen (13). We do not knowingly collect personally identifiable information from anyone under the age of thirteen (13). If you are a parent or guardian and become aware that your child has provided us with Personal Data, please contact us. It we become aware that we have collected Personal Data from anyone under the age of thirteen (13) without verification of parental consent, we will take steps to remove any information from our servers or records.

The Personal Information of minors will be collected through their legal guardian or parent only where products or services are obtained for the minors.

Use of Personal Information

We may use your Personal Data for the following purposes:

To provide and maintain our service, including to monitor the usage of our service.
To manage your registration as a user of our service. The Personal Data you provide can give you access to different functionalities of the service that are available to you as a registered user.
To contact you by email, telephone call, WhatsApp, or other equivalent forms of electronic communication.
To provide you with news, special offers and general information about our guest experiences, reserve and lodge, unless you have opted not to receive such information.
To attend and manage your requests, requirements and preferences that you might require during your stay or usage of our services.
We may use your information for other purposes, such as data analysis, identifying trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our services and guest experiences. We may also use your personal information to update our guest records.
To prove to your financial institution that you used our service and lodge in the case where there might be a discrepancy in a payment that was made by your financial institution to us.

If we intend to use your Personal Information for a different purpose, Inzalo Safari Lodge will provide you with the ability to decline this service.

Use of Financial Information

Should you supply us with any financial information for the purpose of transferring funds, such as a refund, we undertake to only use such information for the purpose it is meant for.

Personal Information sharing and data transfers

We may disclose your Personal Information to third parties where required by law, where it is necessary to give effect to a contract with you, or where we have a legitimate interest in doing so. These are some of the instances where we may share your Personal Information with third parties, who may include:

to any person that provides services (which services may include verifying, updating and processing Personal Information) to Inzalo Safari Lodge or acts as Inzalo Safari Lodge's agent or to whom Inzalo Safari Lodge have transferred or propose to transfer any of its rights and duties in respect of its customers (some of these persons may be located outside of the Republic of South Africa), and share Inzalo Safari Lodge customers’ Personal Information with Inzalo Safari Lodge's service providers, locally and outside the Republic of South Africa, as necessary. Inzalo Safari Lodge may ask persons who provide services to Inzalo Safari Lodge to agree to our Privacy practices and related policies if they need to access any Personal Information to carry out their services.
to Inzalo Safari Lodge's legal advisors, financial advisors, auditors, regulatory authorities or in response to a legal proceeding or to a competent court; and
to Inzalo Safari Lodge’s subsidiaries.

We will not share your Personal Information to external organizations that are not our service providers, unless business operations require the processing of your personal information in other countries, either to carry out processing based on your instructions or for ordinary business purposes.

Should we wish to store your information with a third party, who is located outside of South Africa and receives the Personal Information, they will need to comply to either a law, or binding agreement which states that they will provide an adequate level of protection to your Personal Information. This means that they must agree to lawfully process your Personal Information and protect your Personal Information in the same manner as we do.

Retention of Personal Information

Inzalo Safari Lodge will not keep your Personal Information beyond the period strictly necessary for the purposes for which it was collected, and in accordance with the Applicable Legislation.

Inzalo Safari Lodge undertakes, where possible, to anonymise or delete your Personal Information as soon as the purpose and/or the duration of their established retention expire.

Nevertheless, Personal Information may be archived beyond the applicable periods for the purposes of researching, investigating, and prosecuting criminal offences with the sole purpose of allowing, as needed, the provision of such Personal Information to the judicial authorities, or for other retention obligations, for accounting or fiscal purposes. Archiving implies that this Personal Information will be subject to access restrictions and will no longer be available online but will be retrieved and kept on a secure and independent device.

However, as the website is accessible via the internet, and the internet is inherently insecure, we cannot guarantee the security of information you send to us online (including that it will not be intercepted). You have the right and responsibility to ensure that the Personal Information we hold about you is accurate. In the absence of evidence to the contrary, we will assume that the information you provided to us is accurate. Inzalo Safari Lodge is the sole owner of the information collected on the Sites. We will not sell, share, or rent this information to others in ways different from what is disclosed in this notice or elsewhere in the Sites contrary to manner described in this notice.

Mandatory Disclosure of Personal Information

Inzalo Safari Lodge Sites may disclose Personal Information if required to do so by law or in the good-faith belief that such action is necessary to (a) comply with applicable law or with legal process served on Inzalo Safari Lodge and/or its subsidiaries or the Sites; (b) protect and defend the rights or property of Inzalo Safari Lodge, or the Sites, and (c) act under exigent circumstances to protect the personal safety of users of goods and services of Inzalo Safari Lodge, the Sites, or the public.

Third Party Sites

Inzalo Safari Lodge encourages you to review the Privacy Notice of third-party websites and applications (“Third Party Sites”) you choose to link to from Inzalo Safari Lodge’s Sites so that you understand how those Third-Party Sites collect, use, and share your information. Inzalo Safari Lodge is not responsible for the Privacy Notices or other content on Third Party Sites outside of Inzalo Safari Lodge.

Indemnity

You accept that Inzalo Safari Lodge takes reasonable and practical steps to safeguard Protected Personal Information in its possession. To the fullest extent permissible by law, you hereby indemnify and holds harmless Inzalo Safari Lodge, its employees and agents against any liability, damages and/or legal action whatsoever and howsoever arising, including negligence on the part of Inzalo Safari Lodge, its employees or agents and Inzalo Safari Lodge shall not accept liability for any damages, or any type of loss suffered by you when utilizing the services of the Sites and Third-Party Sites.
